Consolidated Guidance to Intelligence Officers and Service Personnel on the Detention and Interviewing of Detainees Overseas, and on the Passing and Receipt of intelligence Relating to Detainees.

Published on 6 July 2010, the Guidance was the subject of two legal challenges: one brought by the Equalities and Human Rights Commission (EHRC) and the other brought on behalf of Alaa' Nassif Jassim Al-Bazzouni, a victim of hooding in Iraq.

The EHRC argued that the Guidance failed to protect detainees from harm because it only prohibited intelligence officers from interviewing detainees if there was a 'serious risk' of torture.  The correct legal test, according to the EHRC, was whether there was a 'real risk' of torture.  The Court dismissed the claim, rejecting the distinction between the two terms.

The Court, however, found in favour of Mr Al-Bazzouni, ruling that the hooding of detainees during interrogation was unlawful.

The Guidance was revised to reflect the judgment.

The Information Commissioner issued the first of two decisions in response to the APPG's complaint about the MOD's failure to disclose information under the Freedom of Information Act (FOIA).  The IC agreed with the MOD's refusal to disclose on most issues but required it to publish some requested information.

This is the Information Commissioner's second decision in relation to a related APPG complaint about the MOD's failure to disclose other information under the Freedom of Information Act (FOIA).  The APPG's complaints were upheld in whole or in part and the MOD was required to disclose some of the requested information.  The original requests are published in the letters section of this website.
