Published on 6 July 2010, the Guidance was the subject of two legal challenges: one brought by the Equalities and Human Rights Commission (EHRC) and the other brought on behalf of Alaa' Nassif Jassim Al-Bazzouni, a victim of hooding in Iraq.

The EHRC argued that the Guidance failed to protect detainees from harm because it only prohibited intelligence officers from interviewing detainees if there was a 'serious risk' of torture.  The correct legal test, according to the EHRC, was whether there was a 'real risk' of torture.  The Court dismissed the claim, rejecting the distinction between the two terms.

The Court, however, found in favour of Mr Al-Bazzouni, ruling that the hooding of detainees during interrogation was unlawful.

The Guidance was revised to reflect the judgment.

This letter, from the then Foreign Secretary Margaret Beckett, to the Bishop of Bath and Wells, Rt Rev Peter Price, dated 20 April 2006, refers to the al-Rawi and Binyam Mohamed cases. This was released following the April 2012 judgment of the First Tier Tribunal (Information Rights) concerning the APG's appeal against the Foreign and Commonwealth Office.
