Published on 6 July 2010, the Guidance was the subject of two legal challenges: one brought by the Equalities and Human Rights Commission (EHRC) and the other brought on behalf of Alaa' Nassif Jassim Al-Bazzouni, a victim of hooding in Iraq.

The EHRC argued that the Guidance failed to protect detainees from harm because it only prohibited intelligence officers from interviewing detainees if there was a 'serious risk' of torture.  The correct legal test, according to the EHRC, was whether there was a 'real risk' of torture.  The Court dismissed the claim, rejecting the distinction between the two terms.

The Court, however, found in favour of Mr Al-Bazzouni, ruling that the hooding of detainees during interrogation was unlawful.

The Guidance was revised to reflect the judgment.
